ASAMW invites all subcontractor members to join us on April 16 for a discussion on how to deal with terms in the subcontracts you face in today’s market.  Every GC has its own Subcontract and the GCs attorney is dictating terms to protect the GC, but that puts a lot of risk on the subcontractor.  Seasoned professional subcontractors and a construction attorney will address how they deal with the difficult terms and conditions, (when made part of the bid documents).  Discussion items include:

  • Pre-bid Preparation - when the boilerplate subcontract language is included in the documents, (Contractors need to decide on what factors matter and when to walk away and when to take the risk).
  • What if they say “You cannot touch the boilerplate?”
  • What do you do if you are awarded the project. What changes can you make to the subcontract scope of work to make a difference and lessen the risk.
